ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION – Private Vessel Use

I acknowledge that GLLPS has offered complimentary transportation to and from Greens Ledge Lighthouse and that I voluntarily choose instead to approach, dock, moor, and/or leave a privately owned vessel (“Vessel”) at or near the Lighthouse.

I understand that the Lighthouse, dock, and mooring are in an exposed marine environment subject to wind, waves, tide, current, surge, and significant wake from unrestricted vessel traffic (no “No Wake Zone”).

Conditions may change rapidly and unexpectedly. I understand that vessels may sustain damage even when properly secured, including line or fender failure, breakaway, collision/allision, water intrusion, partial or total loss, and the need for towing or salvage. I have not relied on GLLPS for weather, navigation, or safe mooring decisions.

I accept full responsibility for the operation, approach, docking, mooring, and securing of my Vessel and for all persons associated with it. I am solely responsible for determining whether conditions are safe.

Assumption of Risk. To the fullest extent permitted by law, I knowingly and voluntarily assume all risks of loss, damage, injury, or death arising out of or related to my use of a private Vessel at or near the Lighthouse.

Release. To the fullest extent permitted by law, I release, waive, and discharge GLLPS and its representatives from any and all claims or liabilities arising out of or related to such use, including property damage, personal injury, death, towing, and salvage.

Indemnification. I agree to defend, indemnify, and hold harmless GLLPS from any claims, damages, or expenses arising from my Vessel, its operation, docking/mooring, breakaway, or any injury or damage caused by me or persons associated with my Vessel.

GLLPS makes no warranties regarding the condition or safety of the dock, mooring, or surrounding waters. This Agreement is governed by Connecticut law and applicable federal maritime law.
